BanXian Terms of Service

Welcome to BanXian (半仙). These Terms of Service ("Terms") form a legally binding agreement between you and the operator of the App ("we", "us") governing your use of the BanXian mobile application and related services (together, the "Service"). Please read them carefully. By using, registering for, or subscribing to the Service, you agree to these Terms; if you do not agree, do not use the Service.

1. Entertainment nature and disclaimers (please read)

1.1 For entertainment only. All content provided by the Service — including but not limited to BaZi charts, Zi Wei Dou Shu, Liu Yao divination, annual/daily forecasts, compatibility readings, and all interpretations by the "Li BanXian" AI — is provided for entertainment and cultural companionship purposes only. It is based on traditional Chinese metaphysical culture, has no scientific basis, and is not guaranteed to be accurate, reliable, or to produce any outcome.

1.2 Not professional advice. Nothing in the Service constitutes, or should be treated as, medical, psychological, health, legal, financial, investment, marital, or any other professional advice. You should not make any major life, health, financial, or legal decision based solely on Service content.

1.3 Your own decisions. You are solely responsible for any decisions you make and actions you take based on Service content. As "Li BanXian" says — "I read only three parts in ten; the other seven are up to you."

1.4 Crisis help. The Service is not a crisis-intervention or emergency tool. If you or someone else is in immediate danger or having thoughts of self-harm, contact local emergency services or a crisis hotline immediately (e.g., 988 in the US, いのちの電話 in Japan, 1995 in Taiwan, 2389 2222 24-hour hotline in Hong Kong).

2. Eligibility and account

2.1 Age. You must be at least 16 years old (or the age of digital consent in your jurisdiction, whichever is higher) to use the Service. If you are under 18, you should use it with the informed consent of a parent or guardian. The Service is intended for adults.

2.2 Registration. The Service uses Sign in with Apple or email magic link to log in. You are responsible for all activity under your account and for safeguarding your login credentials.

2.3 Accurate information. Birth and other information you provide should be as accurate as possible; inaccurate information affects the relevance of charts and readings. You are responsible for the lawfulness of the information you provide (e.g., if you create a chart for another person, you must be entitled to process their information).

3. Subscriptions, billing, and auto-renewal

The Service offers three auto-renewing subscription tiers (prices display in your App Store region; USD base prices below):

3.1 Auto-renewal. Subscriptions auto-renew. Unless you turn off auto-renewal at least 24 hours before the end of the current period, the subscription will renew automatically and your Apple ID will be charged at the price for your selected period.

3.2 Billing. Charges are billed to your Apple ID account upon confirmation of purchase. Renewal charges apply within 24 hours before the end of the current period.

3.3 Manage and cancel. You can manage or cancel your subscription at any time in iOS Settings → your Apple ID → Subscriptions. Cancellation takes effect at the end of the current paid period; no pro-rata refund is given for the current period (except where required by law or Apple policy).

3.4 Refunds. All purchases are made through Apple, and refunds are handled by Apple under its policies; request refunds via Apple's "Report a Problem" or Apple Support. We generally cannot directly refund Apple In-App Purchases.

3.5 Price changes. We may change subscription prices. Price changes will be notified per Apple's rules and, where applicable, your consent obtained before they apply to renewals.

3.6 Free quota and subscriber benefits. Free users get full chart calculation, an initial reading, and a limited number of daily questions; subscribers get unlimited questions (subject to the fair-use policy in Section 4), unlimited chart profiles, full daily readings, in-depth reports, permanent conversation memory, an ad-free experience, and more. Specific benefits are as shown in the App and may be adjusted from time to time.

3.7 Promotions and referral rewards. We may offer promo codes and referral rewards (e.g., extra question quota for both parties; subscription time granted to the referrer when a referee subscribes). Rewards are promotional, have no cash value, and are non-transferable and non-redeemable. We reserve the right to cancel and claw back rewards for abuse, fraud, or violations (e.g., if a referee obtains a refund, the corresponding granted time is reclaimed).

3.8 Offer Codes. Subscription-time rewards are issued as App Store Offer Codes; redemption and use are subject to Apple's applicable rules.

4. Acceptable and fair use

4.1 You agree not to: - use the Service for any unlawful purpose or in violation of these Terms, Apple policies, or applicable law; - abuse the API, bypass quota or rate limits via scripts, automation, or scraping; - request or induce content that violates our safety policies (e.g., curses targeting others, prying into others' privacy, harmful content); - reverse-engineer, decompile, or crack the Service, or gain unauthorized access to our systems and data; - resell, sublicense, or commercially redistribute the Service or its output without our written permission.

4.2 Fair use. "Unlimited questions" for subscribers is subject to a reasonable fair-use policy intended to serve genuine personal use. For usage clearly exceeding normal personal use, or suspected automation or abuse, we reserve the right to limit, suspend, or terminate the Service.

4.3 Safety filtering. "Li BanXian" includes output-safety mechanisms that refuse or reframe requests involving predictions of death, medical diagnoses, investment/gambling, harm to others, and similar. This is a necessary part of the product, and you agree not to attempt to circumvent it.

5. Intellectual property

5.1 Our rights. The Service and all its content and technology — including the chart-calculation engines, algorithms, knowledge base, the "BanXian / 半仙" and "Li BanXian" brand names, logo, character persona, UI design, copy, and graphics — are owned by us or our licensors and are protected by copyright, trademark, and other laws. The methodology references traditional Chinese classics (such as public cultural heritage works) as a framework of lineage and does not claim ownership of that public culture itself.

5.2 License. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes only.

5.3 Your content. Content you enter in conversations belongs to you. To provide the Service (including sending it to a third-party AI processor to generate readings, and storing your profiles and memory), you grant us a non-exclusive license to process that content as necessary to operate and improve the Service. See the Privacy Policy.

5.4 Generated content. Readings generated for you are for your personal use. Given the nature of AI-generated content, we do not guarantee its uniqueness, and identical or similar inputs may produce similar outputs.

6. Third-party services

The Service relies on third parties (including Apple, the AI processor DeepSeek, the cloud database Supabase, ad providers, and others). Your use of third-party services may be subject to their respective terms. Note in particular: fortune-telling readings are generated by a third-party AI (DeepSeek, operated by a company based in China), and your input is transmitted to that third party for processing — see Section 4.1 of the Privacy Policy. We are not responsible for the acts of third-party services.

7. Disclaimers and limitation of liability

7.1 "As is." The Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted availability. We do not warrant the accuracy of readings or that any particular outcome will be achieved.

7.2 Limitation of liability. To the maximum extent permitted by law, we and our affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. In no event shall our aggregate liability for the Service exceed the greater of the amount you actually paid us (via Apple) for the Service in the 12 months before the event giving rise to the claim, or US$50.

7.3 Statutory rights. Some jurisdictions do not allow the exclusion of certain warranties or limitation of certain liabilities; to that extent, the above limitations do not apply where prohibited, and you may have additional statutory rights under local law (these Terms do not diminish such non-waivable rights).

8. Indemnification

To the extent permitted by law, you agree to indemnify and hold us harmless from any third-party claims, losses, liabilities, and costs (including reasonable attorneys' fees) arising from your breach of these Terms, misuse of the Service, or infringement of others' rights.

9. Termination

9.1 You may stop using the Service at any time and delete your account via "Delete Account" in the App. Deletion permanently removes your data (see Section 9 of the Privacy Policy); subscriptions must be canceled separately in iOS Settings.

9.2 If you breach these Terms, abuse the Service, or engage in fraudulent/unlawful conduct, we may suspend or terminate your access, without prior notice where necessary.

9.3 Sections 1, 5, 7, 8, 10, 11 and any provisions that by their nature should survive continue in effect after termination.

10. Governing law and disputes

10.1 Except as required by the mandatory laws of your locality, these Terms are governed by the laws of the State of California, USA (excluding conflict-of-laws rules).

10.2 The parties shall first attempt to resolve disputes in good faith. Failing that, disputes shall be submitted to courts of competent jurisdiction in California; where the law of your locality grants you a non-waivable right to sue in local courts or apply local law, that law prevails.

10.3 Consumer rights preserved. Notwithstanding the above, if you are a consumer, mandatory consumer-protection rights granted by the laws of your country/region are unaffected by these Terms.

11. Miscellaneous

11.1 Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Service.

11.2 Severability. If any provision is invalid or unenforceable, the remaining provisions remain in effect.

11.3 No waiver. Our failure to exercise a right is not a waiver.

11.4 Assignment. You may not assign your rights or obligations under these Terms; we may assign in reasonable circumstances (such as a merger or acquisition).

11.5 Changes. We may update these Terms; material changes will be notified via in-app notice or email, and the date at the top updated. Continued use after a change constitutes acceptance.

11.6 Apple terms. You acknowledge that these Terms are between you and us only, and not with Apple, and that Apple is not responsible for the App. As a condition of the App being distributed through the Apple App Store, you acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right (and are deemed to have accepted the right) to enforce these Terms against you. The "Usage Rules" in the App Store Terms of Service also apply to your use of the App.
